Terms and Conditions
This site (shop.roscioli.com) is owned by Salumeria Roscioli Srl, with registered office in Rome, via dei Giubbonari, 21-22, registered in the Rome Company Register no. 1199151, VAT no. 09947871001, and is dedicated to the retail sale of food and non-food products.
Roscioli complies with the regulations regarding distance contracts pursuant to art. 45 and following of Legislative Decree 206/2005 and subsequent amendments.
We invite you to carefully read the general conditions of sale (hereinafter the “Conditions”) below, which constitute a binding agreement for the use of the Site, and to print them and/or save them on another durable medium of your choice.
1. GENERAL CONDITIONS
The Conditions applicable to each individual order will be those displayed on the Site at the time of the order itself. Any new Conditions will be effective from the moment of publication on the Site and will apply only to sales concluded after publication.
2. OFFER TO THE PUBLIC
All products and prices indicated on the Site constitute an offer to the public with the limitations and methods contained in the Site itself and in these Conditions. All products are also present at the Salumeria Roscioli store located in Rome, Via dei Giubbonari, 21-22 (hereinafter the "Store")
3. PRODUCTS
The graphic design of the delivered products may not coincide with that represented on the Site in the event that the manufacturer has modified the packaging and, therefore, for reasons beyond the control of Roscioli. The photos are indicative, the articles may undergo variations compared to the presentation in the catalog or represent the product already cooked or prepared.
4. PRICES AND PROMOTIONS
The Customer's expenditure will be applied exclusively to the price per package calculated at the time of the order, without any consideration of price increases or decreases, even for promotions, which may have occurred subsequently or concluded previously.
All prices include VAT.
Prices are calculated at the time of ordering or when it is modified. Discount coupons and/or vouchers redeemable on subsequent purchases cannot be used for online purchases. To use discount coupons and/or vouchers redeemable on subsequent purchases, you must go to the Store.
5. ACCEPTANCE OF ORDERS
The order sent by the Customer will be binding for Roscioli only if the entire order procedure has been completed regularly and correctly without any error messages being highlighted by the Site. Roscioli will not include in the shopping cart products not expressly ordered by the Customer.
Please note that the shopping lists saved by the Customer will be kept for [30] days following the date of their last modification and will then be automatically deleted.
In case of excessive requests from customers, Roscioli reserves the right to limit the number of orders that can be placed by each customer in a given period.
6. ORDER CONFIRMATION
Following the purchase and only upon regular payment of the price in the manner provided for in art. 11, the Customer will receive confirmation of the order placed in his email inbox with a summary of the products, their prices and the tracking reference of the courier responsible for the delivery in order to be able to verify the status and delivery times.
7. CANCELLATION AND MODIFICATION OF THE ORDER
In addition to the provisions of point 14), the Customer may modify and cancel the order within 24 hours of receiving the order confirmation email. Likewise, Roscioli, following unforeseen logistical and organizational difficulties, may cancel the order by notifying the Customer via email or, by prior agreement with the Customer, modify it. In the event of excessive requests from customers, Roscioli reserves the right to limit the number of changes to orders already placed.
8. DELIVERY
Roscioli delivers groceries only in the areas specified on the Site and at the time slots set by the courier in charge. The delivery service is also guaranteed only for homes reachable by the courier. The staff will simply deliver the goods to the landing in front of the front door of the home. For organizational reasons and efficiency of the service, the groceries cannot be verified or checked by the Customer at the time of delivery. For any anomaly found, contact Customer Service.
Roscioli will not be responsible for any delays that occur during transport. Likewise, Roscioli cannot be held responsible for any loss, damage, incorrect or failed delivery caused by events and/or causes of force majeure or unforeseeable circumstances, such as, but not limited to: natural disasters, adverse weather conditions (such as heavy snowfall), any strikes (of its own or other employees), accidents to means of transport, explosions, or any other cause, similar or different. The cost of delivery is not included in the price of the products.
DELIVERY FACILITIES
a. FREE DELIVERY FOR DISABLED PEOPLE
To benefit from free delivery, the disabled person must suffer from a pathology for which a disability equal to or greater than 60% is recognized. To benefit from the discount, you must fill out the form by entering the data requested at the following link [] for delivery and attach a copy of a suitable certification from the competent ASL attesting to the percentage of disability (certificate of disability for company use) without indicating the relative pathology. At the same link, the Customer must also provide consent to the information for the processing of personal data. Roscioli reserves the right to verify the continued possession of the requirements for recognition of the discounts. The discount can also be requested by a Customer who is a parent of a disabled person who is not of age, or by his/her guardian, provided that the latter possesses the required requirements.
b. DISCOUNTED DELIVERY FOR PEOPLE OVER 70 YEARS OLD
The delivery discount is activated automatically when you turn 70 based on the personal data provided when you activate your account. The discounted rates for disabled and elderly people are valid for the forwarding of only one purchase per month; the standard rate will be applied to subsequent purchases. The date of delivery of the order will be used to verify the limitation.
9. UNAVAILABLE PRODUCTS AND PURCHASE LIMITATIONS
Roscioli will not be in any way responsible for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, Roscioli undertakes not to charge the Customer the corresponding price. The site highlights the cases in which limitations on the purchase of individual products apply.
10. FAILURE TO DELIVERY
For delivery, the presence of the Customer or a person appointed by him is required at the address indicated in the order and at the time communicated by the courier in charge of delivery. If the Customer (or the person appointed) is not present, the order will be considered cancelled and the Customer will be charged (as a penalty, also on subsequent expenses) the cost of delivery and that of the products ordered. In this case, therefore, the Customer will not be entitled to any refund of the price for the order placed.
11. PAYMENT
The purchase can be paid by the Customer only online through:
A. Credit, debit and prepaid cards enabled for online payments from the MasterCard, Visa and American Express circuits.
B. Paypal
C. Stripe
Payment will be made upon confirmation of the purchase order. Except for the cases provided for in art. 7 and 13, refunds and/or returns, even partial, of the price are not possible. Cash payment methods are not accepted.
2. INVOICE
The issuing of an invoice is not mandatory, unless requested by the Customer no later than the time of placing the order as indicated in the Presidential Decree of 26/10/1972 n. 633 – art.22, by express mention in the “Notes” section.
3. RIGHT OF WITHDRAWAL
The Customer's rights are protected by Legislative Decree 206/2005 and subsequent amendments. The Customer therefore has the right to withdraw from the contract, even partially, without explanation and without additional costs, provided that the withdrawal is communicated by registered letter with return receipt to Roscioli - E-commerce Customer Service, or by certified electronic mail (pec) within 14 working days from the day of receipt of the products. The communication may be anticipated, within the same term, by e-mail, fax or telegram, provided that it is confirmed by registered letter with return receipt or pec within the following 48 hours. This communication must specify the intention to withdraw from the purchase and the product or products for which the right of withdrawal is to be exercised, attaching a copy of the receipt. The Customer must then return the product to the Store at his own expense.
If the withdrawal has been exercised in accordance with the methods described, Roscioli will refund the amount paid for the purchase of the product within 14 days from the date on which Roscioli became aware of the exercise of the right of withdrawal by the Customer. The amount refunded will be net of delivery costs. The Customer will be responsible for the decrease in value of the returned goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods themselves.
Without prejudice to the above, the right of withdrawal is not permitted in the case of:
A. purchase of sealed packaged products, opened by the Customer;
B. of goods packaged to measure or personalized (e.g. delicatessen products);
C. of goods which by their nature cannot be returned or are liable to deteriorate or expire rapidly (e.g. perishable food products or delicatessen products);
D. virtual products (for example and not limited to: vouchers or gift cards)
4. SUSPENSION OF SERVICE In the event of serious breaches by the Customer (for example but not limited to: failure to pay for the purchase made, repeated absence of the Customer at the time of delivery of the purchase, incorrect use of methods of carrying out the purchase), Roscioli, after written notice to the Customer, reserves the right to suspend the service.
5. RESPONSIBILITY
Roscioli guarantees compliance, in general, with the quality standards relating to the products (especially food) exclusively up to the moment of delivery to the courier responsible for delivery to the Customer; any liability relating to the poor condition of the products due to improper storage after the moment of delivery to the courier is excluded. Roscioli declines all liability for direct or indirect damages of any nature or in any form they manifest, resulting from the use of the Site and/or the news, photos and information contained therein. Roscioli assumes no liability for the information provided/acquired by individual producers or distributors.
6. PRIVACY
Roscioli will process the Customer's personal data in compliance with the privacy legislation as specified in detail in the information provided at the time of account activation.
7. COMPETENT COURT
Any and all disputes that may arise in relation to the application, interpretation and execution of these Conditions will be devolved without fail to the judge of the place of residence or domicile of the consumer, if located within the territory of the State.
